The purpose of this Privacy Policy is to provide clear and simple information on how Simon processes personal data that may be collected through the website www.simonelectric.com and the links, pages, or content associated with that domain (the “Website”), including data provided through contact forms, requests for information, content downloads, requests for advice, and data derived from the use of cookies or similar technologies.

This Privacy Policy applies to the processing of personal data carried out through the Website by Simon, S.A. and, where applicable to the selected country or market, by the Simon Group companies listed in Annex I, without prejudice to the additional specific information provided in the annexes.

Simon, S.A., with Tax ID A08078651 and registered office at Calle Sancho de Ávila, 66, 08018 Barcelona (Spain), is responsible for the processing of browsing data, cookie management, and the Website’s common tools. You may contact the Data Protection Officer at dpo@simonelectric.com

When the user selects a country and submits an inquiry, request, or form, the relevant Simon Group company listed in Annex I will act as the data controller for the information provided, for the purpose of addressing the inquiry, processing the request, or maintaining the commercial or professional relationship that may arise from it.

In such cases, Simon, S.A. may process such data on behalf of the relevant company, as the provider of the common tools and the technological, administrative, or commercial support for the Website, in accordance with the applicable intra-group agreements.

3.       PERSONAL DATA PROCESSED

Simon may process the following categories of personal data, depending on the forms or features used by the user:

·         Identification and contact data: first name, last name, email address, phone number, country, postal code, and other contact information.

·         Professional or profile data: company, profession, professional field, user type, project type, estimated budget, inquiry, or stated need.

·         Data provided by the user in free-text fields: project description, comments, issues, requests, or additional information.

·         Browsing and website usage data: IP address, online identifiers, device data, browser, date and time of access, pages visited, language preferences, selected country, and data derived from the use of cookies or similar technologies.

·         Communication preferences and consent: acceptance or rejection of commercial communications, unsubscribe management, and, where applicable, contact preferences.

The user must avoid submitting confidential information, trade secrets, specially protected data, or third-party data without sufficient authorization via forms.

Service providers contracted by Simon or by Simon Group companies acting as data processors or technology providers may also access the data, including providers of technology infrastructure, hosting and web services, security, communications, digital marketing, analytics, and technical support.

Such providers must process the data in accordance with documented instructions and have the required contractual safeguards in place. The data may also be disclosed to public authorities, courts, tribunals, regulators, or third parties when there is a legal obligation to do so or when necessary for the establishment, exercise, or defense of rights.

6.       INTERNATIONAL TRANSFERS

Simon is a group with an international presence. Depending on the country or market selected by the user, the inquiry, request, or form submitted through the Website may be handled by Simon Group companies located outside the European Economic Area. In such cases, personal data may be transferred to or accessed from the country where the company responsible for handling the request is located.

Likewise, certain technology providers, corporate tools, or support services used by Simon or by Simon Group companies may be located in or provide services from countries outside the European Economic Area.

When an international transfer of personal data occurs and Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), applies, Simon will implement the safeguards required by the regulation, including, as applicable, adequacy decisions, Standard Contractual Clauses approved by the European Commission, supplementary measures, or other legally valid mechanisms.

7.       PROFILING, PERSONALIZATION, AND AUTOMATED DECISIONS

When processing is based on consent, the user may withdraw it at any time, without this affecting the lawfulness of the processing carried out prior to its withdrawal.

To exercise their rights, the user may submit a request to dpo@simonelectric.com. The request must allow for the verification of the applicant’s identity and specify the right they wish to exercise.

The user may also file a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the competent supervisory authority in their country, if they believe that the processing of their personal data does not comply with applicable regulations. The appendices may include additional authorities or rights specific to each jurisdiction.

9.       SECURITY

Simon will implement appropriate technical and organizational measures to protect personal data against destruction, loss, alteration, unauthorized access, or accidental or unlawful disclosure.

Access to personal data will be limited to those persons who need to know it for the performance of their duties. Simon and the companies of the Simon Group must maintain access controls and security measures commensurate with the risk.

11.   MODIFICATION OF THE PRIVACY POLICY

Simon may amend this Privacy Policy when necessary to adapt it to regulatory, technical, organizational, or operational changes to the Website. The current version will be the one published on the Website at any given time. If the changes substantially affect the processing activities described, Simon will take reasonable measures to inform users when required.

The Data Controller does not request sensitive personal data through the Website. 

Purposes of processing 

The responsible company will process your data to address and manage your inquiries, requests for information, support, or advice; administer the forms, content, and features of the Website; forward your request to the relevant Simon Group company or department; maintain, where applicable, relationships with customers, prospects, professionals, distributors, or users; ensure the security of the Website; prevent fraud; and comply with legal obligations or regulatory requirements. 

These purposes are necessary to address your request or for the operation of the Website, and therefore do not require your consent. 

With your consent, the Data Controller may also send you promotional communications, newsletters, and information about Simon Group products, news, events, or campaigns, as well as create non-sensitive commercial profiles to tailor communications or content to your professional or commercial interests.

Competent Authority 

The user may contact the Secretariat for Anti-Corruption and Good Governance, which handles private sector matters through the General Directorate of Personal Data in the Private Sector (www.gob.mx/buengobierno ), if they believe their rights have been violated.
